MEMORANDUM OF UNDERSTANDING BETWEEN
McGRAW-HILL BROADCASTING COMPANY, INC.
AND
NATIONAL ASSOCIATION OF BROADCAST
EMPLOYEES AND TECHNICIANS,
THE BROADCASTING AND CABLE TELEVISION WORKERS OF THE COMMUNICATIONS WORKERS OF AMERICA, AFL-CIO
The parties agree that:
(1)
Section 1.4 does not mean that either party waives the right to bargain collectively with respect to any subject matter not referred to or covered in the Agreement.
(2)
The word “regular” in Article 3 may not be construed to permit the Company to unilaterally reduce the eight-hour day or forty-hour week.
(3)
The turnaround pay provided in 3.5 and 3.5.1 does not apply to an employee whose request for a schedule change is granted, nor to an employee who consents to have his schedule changed in order to accommodate the request of another employee. This paragraph does not apply to requests granted pursuant to Section 3.4.4.
(4)
Excused absences shall be considered “hours” as defined in Sections 3.8.1 and 3.8.2.
(5)
The masculine, feminine, and neuter import one another.
(6)
The Cox Communications-KGTV Joint Venture Cable Channel: When KGTV assigns off-air personnel to perform work for the joint venture, all work on the production shall fall within the terms of this contract. However, news photographers, editors other news employees assigned to those jobs may shoot and edit occasional pieces for the joint venture. Clips of joint venture material may be used on KGTV newscasts and news specials.
(7)
The parties agree that: KGTV may receive taped news footage from Tom Borgenson transmitted with non-KGTV microwave equipment over KGTV-licensed frequencies. No part of this agreement shall be considered precedent-setting and the agreement shall expire when Borgeson’s NABET-CWA Local #54 membership is terminated or 1/31/06, whichever is earlier.
